3charter school fails to respond appropriately to a school assignment or directive from
4instructional staff within 5 school days, the governing body of the virtual charter
5school shall notify the pupil's parent or guardian.
AB870-ASA2,6,176 2. The third time in the same semester that a pupil attending a virtual charter
7school fails to respond appropriately to a school assignment or directive from
8instructional staff within 5 school days, the governing body of the virtual charter
9school shall notify the pupil's parent or guardian, the school board that contracted
10for the establishment of the virtual charter school, the school board of the pupil's
11resident school district, and the department. The school board that contracted for
12the establishment of the virtual charter school may transfer the pupil to his or her
13resident school district. If the pupil is a resident of the school district that contracted
14for the establishment of the virtual charter school, the school board may assign the
15pupil to another school or program within that school district. If the school board
16transfers or assigns a pupil, it shall notify the pupil's parent or guardian and the
17department.
AB870-ASA2,6,2218 3. The parent or guardian of a pupil transferred to the pupil's resident school
19district under subd. 2. may appeal the transfer to the department within 30 days
20after receipt of the notice of transfer. The department shall affirm the school board's
21decision unless the department finds that the decision was arbitrary or
22unreasonable.
AB870-ASA2,7,223 (h) Enrollment limit. 1. Except as provided in subds. 2. and 3., in the 2009-10
24and 2010-2011 school years, a virtual charter school may not enroll more pupils

1through the open enrollment program under s. 118.51 than it enrolled through the
2open enrollment program under s. 118.51 on September 19, 2008.
AB870-ASA2,7,43 2. The limit under subd. 1. does not apply to the sibling of a pupil who was
4enrolled in the virtual charter school on September 19, 2008.
AB870-ASA2,7,65 3. The limit under subd. 1. does not apply to a pupil who was enrolled in a
6different virtual charter school on September 19, 2008, or to a sibling of that pupil.
AB870-ASA2,7,97 (i) Enrollment increases. In the 2011-12 to 2014-15 school years, the number
8of pupils attending a virtual charter school through the open enrollment program
9under s. 118.51 may not exceed the number determined as follows:

11open enrollment program under s. 118.51 on September 19, 2008, by the total
12number of such pupils attending all virtual charter schools on September 19, 2008.

AB870-ASA2,9,2221 (a) The legislative audit bureau shall perform a financial and performance
22evaluation audit of virtual charter schools. The audit shall do all of the following:
AB870-ASA2,9,25 231. Compare the amount paid by the state for pupils attending a virtual charter
24school through the Open Enrollment Program to the actual educational costs of
25pupils attending virtual charter schools.

12. Determine the actual and potential effects of state payments for pupils
2attending virtual charter schools through the Open Enrollment Program on the
3budgets of the school districts in which the pupils reside and on other school districts.
AB870-ASA2,10,6 43. Compare the academic achievement of pupils who attend virtual charter
5schools to the academic achievement of pupils of similar socioeconomic backgrounds
6who attend other public schools.
AB870-ASA2,10,8 74. Determine the amount of pupil-teacher contact, categorized by grade level,
8occurring in virtual charter schools.
AB870-ASA2,10,10 95. Determine the percentage of pupils attending virtual charter schools to
10which each of the following applied in the previous school year:
AB870-ASA2,10,11 11a. The pupils did not attend school.
AB870-ASA2,10,12 12b. The pupils attended a public school other than a virtual charter school.
AB870-ASA2,10,13 13c. The pupils attended a private school.
AB870-ASA2,10,14 14d. The pupils attended a home-based private educational program.
AB870-ASA2,10,17 156. Determine the effect of the enrollment limit under section 118.40 (8) (h) of
16the statutes, as created by this act, on the ability of pupils to attend virtual charter
17schools.
AB870-ASA2,10,2018 (b) The bureau shall submit copies of the audit report to the chief clerk of each
19house of the legislature for distribution to the appropriate standing committees in
20the manner provided in section s. 13.172 (3) of the statutes by December 30, 2009.
AB870-ASA2, s. 20 21Section 20. Effective dates. This act takes effect on the day after publication,
22except as follows:
AB870-ASA2,10,2423 (1) The treatment of sections 118.40 (4) (b) 1. and (8) (d) and 121.83 (4) of the
24statutes takes effect on July 1, 2008.
